[If these statistics are anywhere near correct, then it appears that you INCREASE your chances of injury or death by wearing a belt or helmet.  If seatbelts truly were a good thing, then why do the same agencies who publicly claim to protect our children allow them to ride school buses WITHOUT seatbelts? -- Tribble]

The U.S. Department of Transportation's National Highway Transportation Safety Administration only estimates the number of lives saved every year by motorists wearing seat belts and motorcyclists wearing helmets. Statistics provide some startling facts:

According to the California Highway Patrol's most available data, 2001, there were 2,764 fatal automobile accidents that year. Those killed wearing seat belts numbered 1,496. The number killed not wearing a seat belt: 1,268. Of the 266,777 injury accidents that same year, the number injured wearing a seat belt: 237, 028. Those injured not wearing a seat belt: 29,749.

1,496 with belts = 54%
  compared to

In the motorcycle category, there were 295 fatalities the same year. Number of motorcycle operators killed wearing a helmet: 254. Number killed not wearing a helmet: 41.

According to constitutional criminal defense attorney, Larry Becraft of Huntsville, Alabama (search):

From these statistics that you have provided during our interview, it clearly appears that this exercise of the police power, making helmets for cyclists and seat belts for car passengers mandatory, is not being implemented for 'the public good,' but obviously because some vested interests desire it.”

Everyday life in the wake of the Sept. 11 terrorist attacks on the U.S. has changed in many aspects of American society, but some think worries about security are going a bit too far with the rejection of a Girl Scout event at a Florida mall.

Treasure Coast Square Mall becomes 'no-Scout zone'?

A scavenger hunt and lunch had been planned for the Martin County Girl Scouts annual father-daughter day, and organizers thought they had the perfect venue at the Treasure Coast Square mall in Jensen Beach, Fla.

"The merchants and the food court restaurants thought it was a wonderful idea," Genie Stracuzzi, a troop leader and chairman of the event told the Palm Beach Post. "We scoped them out first because we wanted to see what the response would be. It was overwhelming."

But the paper reports Rachelle Crain, the mall's marketing director, had a different take, and rejected the May 1 event, citing a post-Sept. 11 security policy banning group activities.

"It just totally blew our minds," Stracuzzi said. "These are good girls."

Though company officials reportedly refused to answer questions, Crain did issue an e-mail to the Post, stating:

"Historically, we have enjoyed a positive relationship with the Girl Scouts. In this case, however, upon reviewing their request for the father/daughter event, we felt the scavenger hunt portion was not conducive to the mall environment.

"We offered to work with them to create an activity that we could accommodate at the mall and are willing to do an event that is mutually amenable to both groups."

The Palm Glades Girl Scout Council is disappointed things didn't work out with the mall, but understands the decision.

"We have really enjoyed a positive relationship with the mall and many of the merchants have been very supportive," spokeswoman Lisa Johnson told the Post. "It's unfortunate. If their policy is to protect their shoppers, they certainly have to adhere to that."

But Scout moms are said to be perplexed by the ban, not comprehending why the mall allows morning exercisers who walk the facility in groups, while precluding the Girl Scouts.

The father-daughter event has been rescheduled in nearby Stuart, where merchants say they're eager to have the Scouts.

Ironically, the Treasure Coast Square mall is in the news this week for a security problem unrelated to the Girl Scouts. An elderly couple was mugged in its parking lot Monday evening, leaving the pair hospitalized.

"It was terrible," victim Ann Palmer told the Stuart News in a tearful interview. "Terrible. They broke my arm. I'm 70 years old. ... We can't afford to have broken bones at our age."

[In February, March & April this year and several times last year  wrote about RFID's and particularly about Wal-Mart and Gillette razor having a gig going to track the Mach 3 razor and possibly catch thieves or people who did not put the razor back where they found it.  The race continues with Wal-Mart asking its top 100 suppliers to start using radio frequency identification tags on cases and pallets of goods shipped to the retailer starting in January 2005.]

RFID tags are NOT an "improved bar code" as the proponents of the technology would like you to believe. RFID technology differs from bar codes in three important ways:

    1. With today's bar code technology, every can of Coke has the same UPC or bar code number as every other can (a can of Coke in Toronto has the same number as a can of Coke in Topeka). With RFID, each individual can of Coke would have a unique ID number which could be linked to the person buying it when they scan a credit card or a frequent shopper card (i.e., an "item registration system").

    2. Unlike a bar code, these chips can be read from a distance, right through your clothes, wallet, backpack or purse -- without your knowledge or consent -- by anybody with the right reader device. In a way, it gives strangers x-ray vision powers to spy on you, to identify both you and the things you're wearing and carrying.

    3. Unlike the bar code, RFID could be bad for your health. RFID supporters envision a world where RFID reader devices are everywhere - in stores, in floors, in doorways, on airplanes -- even in the refrigerators and medicine cabinets of our own homes. In such a world, we and our children would be continually bombarded with electromagnetic energy. Researchers do not know the long-term health effects of chronic exposure to the energy emitted by these reader devices.

Wal-Mart has crossed our line in the sand and has begun placing LIVE RFID TAGS on individual consumer goods. Last week, they began stocking the shelves of seven Dallas-Ft.Worth area stores with Hewlett Packard products with live spychips affixed. Wal-Mart has no plans to deactivate the tags at the register and instead tells customers they can deal with the tags themselves.

Wal-Mart executive vice president and chief information officer Linda Dillman said:

"...down the road there are so many possibilities to improve the shopping experience that we hope customers will actually share our enthusiasm about EPCs," Dillman said, referring to the RFID-based Electronic Product Code industry hopes will replace the barcode. "As we look forward five, 10 years, we see the possibility of offering expedited returns, quicker warranty processing and other ways to minimize waiting in lines."

Wal-Mart Tries New PR Spin to Accompany Item-level RFID Tagging  "Selling the technology with partial truths is unethical," says CASPIAN

Despite widespread consumer opposition, Wal-Mart began item-level RFID (radio frequency identification) tagging of consumer goods last week as part of a trial in Texas. In an apparent effort to minimize the backlash to its use of RFID tags, Wal-Mart has also begun a public relations campaign to promote the technology that some are calling unethical.

Shoppers at seven Dallas-Ft. Worth area Wal-Mart stores can walk into the consumer electronics department and find Hewlett-Packard products for sale with live RFID tags attached. Wal-Mart's public statements appear to leave open the possibility that other goods could be tagged with RFID as well.

The giant retailer's decision to tag individual items on the store floor violates a call for a moratorium on such tagging issued last November by over 40 of the world's most respected privacy and civil liberties organizations. The move has sparked sharp criticism by the privacy community.

"Wal-Mart is blatantly ignoring the research and recommendations of dozens of privacy experts," says  Katherine Albrecht, Founder and Director of CASPIAN (Consumers Against Supermarket Privacy Invasion and Numbering). "When the world's largest retailer adopts a technology with chilling societal implications, and does so irresponsibly, we should all be deeply concerned."

In addition to violating the call for a moratorium on RFID-tagged items in stores, Wal-Mart has begun a consumer education campaign that CASPIAN is calling unethical.

"Read the FAQs at the Wal-Mart corporate web site and you'll find plenty of half truths," Albrecht says. "They call it consumer education, but the omissions and spin make it feel more like a calculated disinformation campaign."

Albrecht provides the example of Wal-Mart's statement that RFID tags in its stores are harmless since they contain nothing more than identification numbers. "While technically that's true, Wal-Mart fails to explain what it means for items to carry remote-readable unique ID numbers. It's like saying someone's social security number is 'only' a number, so sharing it with perfect strangers should be of no concern."

Albrecht explains that many major retailers today routinely link shoppers' identity information from credit, ATM and "loyalty" cards with product bar code numbers to record individuals' purchases over time. "If nothing is done to stop it, the same will happen with the unique RFID numbers on products. This means that if retailers can read an RFID tag on a product they previously sold you, they can identify you as you walk in the door and even pinpoint your location in their store as you shop," she said.

Albrecht also criticizes Wal-Mart for failing to tell consumers of the retailer's long-term goals for RFID. "The industry plan is to put an RFID tag on every product on Earth to identify and locate them at any time, anywhere. Wal-Mart is taking the first steps to creating a society where everything could be surveilled at all times. A shopper would hardly learn this by reading their website."

With potentially billions of dollars riding on RFID, global corporations are eager to see it deployed. However, consumer acceptance has proved to be an obstacle.

Procter & Gamble's own research suggests that 78 percent of consumers surveyed reacted negatively to the technology on privacy grounds and did not find industry reassurances compelling. Another industry study, published in January 2003, found similar misgivings among focus groups of consumers in the U.S., Germany, France, Japan and the UK.

The most publicized trial of item-level RFID tagging to date, Metro-AG's "Future Store" in Rheinberg, Germany, met with massive consumer outcry earlier this year, culminating in a protest outside the store.

"Wal-Mart may soon be facing a similar backlash," said Albrecht.

ACLU opposes petition, but backs Hansen's right to petition

CARSON CITY -- The American Civil Liberties Union will represent political activist Janine Hansen, who was arrested last week while gathering signatures for a petition that the ACLU opposes.

Hansen and her 25-year-old son, Zachary Triggs, were arrested Thursday night at the municipal bus station in Reno and charged with trespassing. They were gathering signatures on a petition for a constitutional amendment to bar government employees from serving in the Legislature.

The ACLU last week submitted a "friend of the court" brief to the Nevada Supreme Court, supporting the right of public employees to serve in the Legislature.

Although they are on opposite sides of that debate, in the case of the trespassing charges, "the issue is not about the petition. It's about the right to petition," Hansen said.

Allen Lichtenstein, the ACLU's Las Vegas attorney, said, "The right of free speech does not depend on whether you agree or disagree with the person's sentiments."

Lichtenstein said there is nothing strange about the ACLU representing Hansen, who is an officer of the Independent American Party. He said the ACLU is trying to "protect the constitutional rights and civil liberties" of Hansen and her son.

Hansen refused to accept the policies of the Regional Transportation Commission that placed restrictions on the right to gather signatures at the bus station.

Lichtenstein said the commission clearly violated a law enacted in 2003, which does not allow the commission to restrict signature gathering.

The first court appearance for Hansen and her son is set for May 27.

Hansen said she and the ACLU have worked together on several issues, such as the Nevada Patriot Act and the privacy laws. On the Patriot Act, she said both groups were worried that citizens who protested against the government could be considered terrorists. She said that was taken out of the bill.

Janine Hansen, an activist with the anti-tax group Nevadans for Sound Government, was arrested and jailed Thursday night while gathering signatures on two petitions at the Regional Transportation Center in Reno.

The petitions seek to repeal the $833 million in tax increases approved by the 2003 Legislature and to require enforcement of the long-flouted constitutional provision which bars government employees from serving in the state Legislature.

Ms. Hansen's arrest comes on the heels of a complaint filed Monday with Las Vegas police and Secretary of State Dean Heller by Ms. Hansen's brother, Christopher Hansen, contending two Nevada Highway Patrol officers, several Department of Motor Vehicles employees, officials with UNLV, and others have prevented the petitioners from collecting signatures.

Secretary of State Heller, the state's chief election officer, issued an order last fall confirming the right of citizens to gather signatures without giving advance notice at government offices. Greg Bortolin, Gov. Kenny Guinn's spokesman, contended April 30 that state officials "in no way will impede" petition gathering efforts.

Indeed, citizens have every right to seek petition signatures on public property at any time, place and manner that doesn't create a hazard or substantially block the flow of traffic. So why are these people being harassed, and even jailed?

In America, the right of the citizens to petition for a redress of grievances is constitutionally protected. That means it's the highest law of the land.

You remember the Constitution, don't you, officers? It's that faded old document that charges you with protecting our liberties -- the reason citizens fund your paychecks.

[this if probably a fictional story, but like a parable, it tells a good message. - Tribble]

A young man learns what's most important in life from the guy next door.  It had been some time since Jack had seen the old man.

College, girls, career, and life itself got in the way. In fact, Jack moved clear across  the country in pursuit of his dreams.   There, in the rush of his busy life, Jack had little time to think about the past and often no time to spend with his  wife and son. He was working on his future, and nothing could stop him.     Over the phone, his mother told him ,  "Mr.Belser died last night.The funeral IS  Wednesday."

Memories flashed through his mind like an old newsreel as he sat quietly remembering his childhood days.

 "Jack, did you hear me?"

"Oh, sorry, Mom. Yes, I heard you. It's been so long since I thought of him. I'm sorry, but I honestly thought he died years ago," Jack said.

"Well, he didn't forget you. Every time I saw him he'd ask how you  were doing. He'd reminisce about the many days you spent over 'his side of the fence' as he put it," Mom told him.

"I loved that old house he lived in," Jack said.

"You know, Jack, after your father died, Mr. Belser stepped in to make sure you had a man's influence in your life," she said.

"He's the one who taught me carpentry," he said. "I wouldn't be in this business if it weren't for him. He spent a lot of time teaching me things he thought were important...Mom, I'll be there for the funeral," Jack said.

As busy as he was, he kept his word. Jack caught the next flight to his hometown. Mr. Belser's funeral was small and uneventful. He had no children of his own, and most of his relatives had passed away.

The night before he had to return home, Jack and his Mom stopped by to see the old house next door one more time.

Standing in the doorway, Jack paused for a moment. It was like crossing over into another dimension, a leap through space and time.

The house was exactly as he remembered. Every step held memories.

Every picture, every piece of furniture....Jack stopped suddenly.

"What's wrong, Jack?" his Mom asked.

"The box is gone," he said.

"What box? " Mom asked.

"There was a small gold box that he kept locked on top of his desk.

I must have asked him a thousand times what was inside. All he'd ever tell me was 'the thing I value most,'" Jack said.

It was gone. Everything about the house was exactly how Jack remembered it, except for the box. He figured someone from the Belser family had  taken it.

"Now I'll never know what was so valuable to him," Jack said. "I better get some sleep. I have an early flight home, Mom."

It had been about two weeks since Mr. Belser died.

Returning home from work one day Jack discovered a note in his mailbox. "Signature required on a package. No one at home. Please stop by the main post office within the next  three days," the note read.

Early the next day Jack retrieved the package. The small box was old and looked like it had been mailed a hundred years ago. The handwriting was difficult to read, but the return address caught his attention.  "Mr. Harold Belser" it read.

Jack took the box out to his car and ripped open the package. There inside was the gold box and an envelope. Jack's hands shook as he read the note inside.

"Upon my death, please forward this box and its contents to Jack  Bennett. It's the thing I valued most in my life." A small key was taped to the letter. His heart racing, as tears filling his eyes, Jack carefully unlocked the box. There inside he found a beautiful gold pocket watch. Running his fingers slowly over the finely etched casing, he unlatched the cover.

Inside he found these words engraved: Jack, Thanks for your time!

"The thing he valued most...was...my time."

Jack held the watch for a few minutes, then called his office and cleared his appointments for the next two days. "Why?" Janet, his assistant asked.

"I need some time to spend with my son," he said.

"Oh, by the way, Janet...thanks for your time!"

After about a month, the boy came back and again asked his father if they could discuss his use of the car. They again went into the father's study where the father said, "Son, I've been very proud of you. You have brought your grades up, you've studied the Bible
diligently, but you didn't get your hair cut."

The young man waited a moment and then replied, "You know, Dad, I've been thinking about that. You know Samson had long hair, Moses had long hair, Noah had long hair, and even Jesus had long hair."

Re-institute the Draft?

There NEVER has been a draft in the uSA since the 2nd 13th Amendment.  Yes, I did say 2nd 13th Amendment, and that is because there was a 1st which the powers that be went to great lengths to remove from public knowledge, but fortunately they were not completely successful from a historical perspective, even though they may have been successful in a legal sense.  But this 1st 13th Amendment is a topic for another discussion.  We are interested here in the one that reads
 

“Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.”


Belief

I know there are many who argue fervently that they were drafted.  I know they believe that, and they are supposed to believe it, just like you are supposed to believe you are drafted if your turn ever comes.

There are many reports that, like email chain letters and hoaxes, circulate through the rumor mill every few months or years.

You read or hear that we need to re-institute the draft because of this reason or that.  This of course pre-supposes that there ever was a draft.

Government

There is Senate and House legislation in the works under the headings of S89 and HR163, to bring a draft into action.

Regardless of the wording of any legislation, there will not be a draft, and there never has been a draft.

Law

Now, let us look again at the 2nd 13th Amendment.

What is Servitude?   It is a condition in which one lacks liberty especially to determine one's course of action or way of life. (Webster's New Collegiate Dictionary, 1973)

What is Draft?  It is to conscript for military service  (Webster's New Collegiate Dictionary, 1973)

What is Conscript?  It is to enroll into service by compulsion  (Webster's New Collegiate Dict, 1973)

What is Conscription?  It is compulsory enrollment and induction into military service  (Black's 5th)

What is Compulsion?   It is an act of compelling  (Webster's New Collegiate Dictionary, 1973) an irresistible impulse to perform an irrational‚ act (Webster's supra)

What is Compulsory?  It is involuntary; forced; coerced by legal process or by force of statute (Black's 5th)

What is Compel?  It is to urge forcefully or irresistibly  (Webster's New Collegiate Dictionary, 1973)

What is Involuntary?  It is without will or power of choice  (Black's 5th)

Clearly a draft is “involuntary servitude” and is expressly prohibited by Law.

Reality

Especially in times of the past century or two, legal terms and legislation have become carefully crafted lingo that is intended to deceive.  While a code appears to say “abc”, it is in reality saying “xyz”.  It is designed to be that way to get public support and sometimes only when someone is personally caught in the snare do they learn the truth.  By then, that person is viewed by the public as a kook or anti ----- (you fill in the blank), because they are crying about the manipulated shenanigans of the bureaucracy.  That person is viewed by the masses as this because the masses still have not escaped their mental cages.

The Draft is one such example.  While it is a matter of Law that there is no Draft, the government is not prohibited from requiring a registration for a Draft.  The government simply has no authority to actually draft you.  So, what happens is you are allowed to believe there is a Draft because there obviously is a registration for a Draft.  Of course, you know it would be absurd to register for something that will not happen, so you believe there must be a Draft.  All the while you never learn about the Law and how there cannot be a Draft.

In times past, people have been required to register for a draft and when their name is picked they honestly believe they have been drafted.  But, in fact, having your named called is not yet a draft, even if there was/is a draft.  The name calling is only to have you go to some office to take some tests and be evaluated for determining if you are military material, to see if you might can do the job.

If you are determined to fit the uniform, then you are asked to sign some papers.  Needing your signature is evidence of your volunteering.  If it was truly a draft, they would not need you to sign anything.  They would simply take you.

Options

Some options are

1   Knowingly volunteer, as many have always done
2   Register for a Draft that cannot happen
     a   If and when your name is called
         1   Sign and volunteer
         2   Not sign, and do not volunteer
     b   If your name is not called, do nothing
3   Run away

Be Afraid
